These terms cover your use of Markwell. By creating an account or using the service, you agree to them. If you are using Markwell on behalf of a school, you confirm you are allowed to accept these terms for it.

01What Markwell is

Markwell reads scanned student worksheets, produces a first-pass score against a rubric you set, and helps you review, approve, and share grades. It is a tool for a teacher, not a replacement for one. A human reviews and approves every grade before it is final, and you are responsible for the grades you approve.

How Markwell protects student data is described in our Privacy & Security page, which is part of these terms. Because the design depends on a classroom routine, you agree to:

05Acceptable use

Do not misuse the service: no attempting to break, overload, or reverse-engineer it; no uploading unlawful content; no using it to harass anyone; and no reselling access without our written agreement. We may suspend an account that puts the service or other users at risk.

06The grading is a first pass

Markwell produces a first-pass score to save you time, not a guaranteed-correct grade. AI reading of handwriting can be wrong. That is why the tool flags uncertain work and requires your approval. You are responsible for reviewing and approving grades before you rely on them. The service is provided "as is," without warranties of accuracy, fitness for a particular purpose, or uninterrupted availability.

07Liability

To the extent the law allows, Markwell is not liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to what you paid us in the twelve months before the claim. Nothing in these terms limits a liability that cannot be limited by law.

08Changes, ending, and contact

We may update these terms; material changes will be noted here and dated, and continued use means the new terms apply. You can stop using Markwell and delete your account at any time. We may end an account for a serious or repeated breach of these terms. These terms are governed by the laws of the State of Indiana, USA.
